Why don't they comply with the Law? The plan of the right is always violent...

In Venezuela , when a citizen does not agree with the election
results, he requests the application of the Electoral Processes Act, which details the actions to be
taken to resolve controversies in that matter.
It is well known, by
anyone in our country, that to contest, ignore and review any electoral
event with which they are not satisfied, this Law is used, which is very
clear and explains the processes that must be followed. This time we will review
some specific articles for this purpose.
After the
presidential elections of July 28, an expected event occurred: The
right wing reported fraud and did not apply any of the actions provided for in the Act
to do so.
So, to show
that the plan of the right wing is always violent, we are going to review what happened
after the presidential elections of 28J. The next day, the
representative of the right-wing candidate,
María Corina Machado, gave a press conference
and stated: “Today we want to tell all Venezuelans and the entire
world that Venezuela has a new elected president and that is Edmundo González Urrutia, it has been
more than an electoral fraud, this is a gross violation of popular sovereignty.”
For his part,
former candidate González Urrutia added that
“Venezuelans and the whole world know what happened today, here all the rules have been
violated, not all the minutes have been handed over. Our struggle
continues and we will not rest until the will of the people is
respected.”
This is how González Urrutia, without any apparent intention
of complying with legal mechanisms, reported the violation of the rules and the
delivery of minutes; when these minutes were held by the National Electoral Council (CNE) and were presented to the Supreme Court in the
at which time he
requested them. Contrary to his speech, they forged minutes and posted them on a
parallel page to the CNE, which is a
flagrant violation of the Law, and when they were requested by the Supreme Court, they did not submit or send them.
Since July 29,
when it declared to the press, until the currents, the right wing represented by Machado and González, has not carried out any legal process to settle
differences in the results, neither in the deadlines set by the Law nor in an extemporaneous manner.
It is important to remember that
on October 17, 2023, the Bolivarian Government and the opposition signed, on the
island of Barbados, a
political agreement, mediated by Norway and
applauded by the United States, regarding democratic
guarantees in the country, within the framework of the organization of the presidential elections.
Within the Barbados agreements that promised to promote political guarantees for
the opposition, the need to
organize a transparent, solid and verifiable electoral process, whose
results would be respected by both parties to the negotiation, was delimited.
However, the candidate
of the Democratic Unitary Platform (PUD), Edmundo González Urrutia, did not sign the agreement issued by the CNE to respect the electoral results.
Even when reviewing the
page of the NGO SÚMATE, which belongs to María
Corina Machado, we see that she has published the Steps
to Contest the Electoral Result since 2013 in her Press Release Súmate #463,
which details the articles covered by the Law to request the challenge of the results.
The Challenging of the Electoral Result provided for in the Organic Law on Electoral Processes (LOPRE),
Chapter III, of articles 203 to 212, establishes that “To challenge an electoral
result, a Hierarchical Appeal must be filed with the National Electoral Council (CNE) )
within twenty (20) business days following the
election. The appeal can also be submitted to the
corresponding Regional Electoral Office to be sent to the CNE, including directly to the
Electoral Chamber of the Supreme Court of Justice. A reason for challenge would be, for
example, some difference between the data recorded in the minutes of the counting,
which must be collected by witnesses and compared with the information published by the CNE”.
It is important to remember that González Urrutia, after the approval of his request for political asylum in Spain, reported that he “took shelter” at
the Dutch embassy the day after the
electoral event, suggesting that there was never an intention to ask for a challenge or review of the presidential elections.
A month after the
elections, the opposition member María Corina
Machado assured that “not a single democratic government in the world has
recognized the re-election of Nicolás Maduro, whose victory in the
presidential elections of July 28 is considered a fraud, just like a large part of
the international community, Venezuela voted for change and
Edmundo González
Urrutia is our elected president,” said the former deputy to hundreds of supporters who gathered in Caracas.
Under the slogan “Act kills
sentence”, the opponents met to defend the proof of the
votes published by the PUD (according to which González Urrutia won
the presidency by a large
margin) and ignored the request for the minutes to the Supreme Court, however, after a month, he did not carry out
no activity related to challenging the fraud you report.
It has been almost 4
months since the elections and the achievements of the right wing have been the organization
of guarimbas, attacks on Institutions, media campaigns of
disinformation, hate speech, among others, and every day that passes,
citizens are clear that the violent and fascist option is not the way to
settle differences, the People chose the peace that only the Bolivarian Revolution offers .
