EDMUNDO GONZÁLEZ URRUTIA AND HIS PARTICIPATION IN THE VIOLATION OF CECILIA NUÑEZ CHIPANA'S HUMAN RIGHTS

(EL NACIONAL, August 9, 1998)

  • Cecilia Núñez Chipana, a Peruvian teacher based in Venezuela and politically persecuted by the government of Alberto Fujimori, was arrested by officials of the General Sectorial Directorate of Intelligence and Prevention (DISIP) while she was teaching in a school in Caracas.
  • From there, Master Núñez was taken to the DISIP and for 85 days she stayed in a very cramped, unventilated cell, which had 32 lights permanently on that maintained a suffocating temperature. During that time, she was prevented from going out to sunbathe or at any time of the day, and was frequently threatened with death and subjected to torture.
  • Edmundo González Urrutia, then Director of Policy of the Ministry of Foreign Affairs, an obedient agent of the Central Intelligence Agency (CIA), in open violation of the Convention against Torture and Other Cruel, Inhuman and Degrading Treatment and Punishment and the system that governs the right to political asylum, said that “the State does not have to explain this case or the extradition”.
  • Supporting a ruling issued by the Supreme Court of Justice (CSJ), which placed the life of the persecuted teacher Núñez Chipana in the hands of the murderous government of Alberto Fujimori.
  • During the decade 1990-2000, Fujimori established in his government the death squad known as the Colina Group, responsible for carrying out the Barrios Altos massacre of November 1991 and the La Cantuta massacre in July 1992, in which dozens of people were killed.
  • Professor Núñez Chipana was on the blacklist of dissidents to that de facto government who should be captured and subject to the sentencing of these Fujimorista squads.
  • On April 5, 1992, Fujimori, with the support of death squads and some gorilla officers from the Peruvian Armed Forces, adopted the Green Plan and carried out a coup d'etat, dissolving all public powers to become a de facto dictator.
  • Following the dissolution of the National Congress and the Supreme Court of Justice of Peru, the arrests, murders and massacres of individuals, left-wing groups and indigenous communities in Peru began, who were subjected to forced sterilizations.
  • In the irregular procedure, supported by Edmundo González Urrutia, to arrest, torture and place teacher Núñez Chipana in the hands of Fujimori, the following rights were violated:
    • a.- violation of personal freedom.
    • b.- violation of the right to the presumption of innocence.
    • c.- violation of the right to due process in the regular asylum procedure requested by the victim.
    • d.- violation of the right to defense, since there are no elements of conviction in the judgment of the CSJ, being replaced by simple suspicions.
    • e.- The teacher's physical integrity was also violated, and she suffered mental and physical abuse during her detention.
    • f.- she was arbitrarily cut off from her relatives without being allowed access to her private lawyers for 85 days.
    • g.- she was illegally expelled from Venezuela, without evidence or reliable grounds to extradite her
    • h.- the victim's alleged link to the Peruvian left-wing group Shining Path, alleged by González Urrutia, proved to be unlikely.
  • In this, like so many other opportunities, González Urrutia's connection with the continental network of death squads that operated with impunity under their auspices in Central America, Venezuela and Peru was once again demonstrated.
