A group of national deputies from the Union for the Fatherland, denounced the president of Argentina, Javier Milei for advancing the agreement with the International Monetary Fund (IMF), through a Decree of Necessity and Urgency (DNU), when the law establishes that indebtedness must be approved by the National Congress, reported the website Page 12.

The complaint was initiated by deputies Juan Marino, Hugo Yasky, Daniel Gollan, Julio Pereyra, Sabrina Selva, Victoria Tolosa Paz and Brenda Vargas Matyi, represented by the constitutionalist Eduardo Barcesat.

He explains that the DNU that the government published in the Official Gazette this Tuesday, March 11, violates articles 75 and 76 of the National Constitution, which provides that any type of indebtedness with international organizations must be approved by Congress.

According to the presentation, the government would also be usurping exclusive functions of the Legislative Branch, while the DNU could constitute an act of “abuse of authority” and “violation of the duties of a public official”, in accordance with articles 248 and 249 of the Criminal Code.

In addition, there is another key point: Article 2 of the Law on Strengthening the Sustainability of Public Debt approved during the Alberto Fernández administration, requires that any financing program with the IMF must be approved by a law of Congress.

On the other hand, the letter submitted to Justice warns that the signing of the decree by the President could affect the “democratic stability” and the “institutional order of the country”, so it requires the immediate suspension of any act that represents an indebtedness of the country without approval of the Parliament, and demands that the Justice notify the Chamber of Deputies and the Senate to intervene in the case and that precautionary measures be taken to prevent the DNU from being executed.

“We don't know the details of the agreement, which will basically be to finance Milei's legislative campaign in 2025, just as Mauricio Macri's agreement was to finance the most expensive election campaign in history. They want to keep the dollar flat before the legislative elections. The country cannot be subject to the electoral needs of La Libertad Avanza,” said Marino, one of the complainant deputies.
