Argentine justice declared six articles of the labor reform of the Milei Decree invalid

These announcements of Argentine justice are made in the midst of a general strike called by the working class against the neoliberal measures of President Milei.

This Wednesday, the Argentine Justice declared six articles of the labor reform invalid, including those of the Necessity and Urgency Decree (DNU) presented by the far-right president Javier Milei.

“Article 73 modifies the conditions for withholding union membership; article 79 establishes rules for collective bargaining; article 86 modifies the validity of mandatory clauses; articles 87 and 88, which in turn incorporate articles 20 bis and 20 ter into law 23551; and 97, which regulates essential services in the context of collective disputes,” explained the national labor judge Liliana Rodríguez.

According to what was published on the TELESUR web portal, Rodríguez clarified that these articles will enjoy “formal validity in the case of ratification by both Chambers within the current extraordinary session, or their validity will cease in full right otherwise.”

In this regard, he pointed out that the content of DNU 70/2023 does not comply with constitutional requirements.
