Argentine Court of Appeals issues precautionary measure against Milei's decree

“This judicial decision puts a brake on regressive labor reform,” said CGT officials

This Wednesday, January 3rd, Argentina's National Labor Appeals Chamber issued a precautionary measure to curb labor reforms established by President Javier Milei's Decree of Necessity and Urgency (DNU), reported on the TN website.

The ruling issued by judges María Dora González, Andrea García Vior and Alejandro Sudera was in response to an appeal filed by the General Confederation of Labor (CGT) of Argentina. And it will be appealed by Milei's management for considering the court's incompetence, TN reported.

“A precautionary measure must be issued suspending the applicability of the provisions of Title IV Work of the Decree of Necessity and Urgency No. 70/23 until a final judgment has been issued on the substantive issue raised in these acts,” reads the resolution, released by the Télam agency.

Milei's so-called 'mega-decree' limits the right to strike, precarious working conditions and reduces severance pay, among other aspects.

Following this decision, the CGT issued a statement celebrating the decision.

“This judicial decision puts a brake on regressive and anti-worker labor reform and will not take effect until the justice system resolves the issue of unconstitutionality of Chapter IV of DNU 70/23, as requested by the General Confederation of Labor,” they said in the labor union.

The document highlights that “the Chamber considers that the position of the CGT does not match the processing of collective proceedings before the federal administrative litigation, to which the government intended to send the file, since the interests are not homogeneous with those that are being discussed in the federal administrative courts, since what is being debated in the labor justice system is the labor law applicable to workers in the Argentine Republic”.
